Privacy Policy

This Privacy Policy explains how Kiteseason s.r.o. (“we”, “us”) collects, uses and protects your information when you use the Kiteseason mobile application (“the App”). By using the App, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Data controller

2. What data we collect

We designed the App to collect only the minimum data necessary to provide its core features: displaying wind data, sending wind alerts, and providing kite size estimates.

2.1 Data you provide directly

The App does not require you to create an account and does not ask for your name, e-mail address, or postal address. The main data you provide are:

• Wind alert settings (wind speed threshold, time windows, and units). These settings are stored locally on your device and on our backend (Cloudflare Worker / KV) so that we can periodically check wind conditions and send you push notifications. We do not use these settings to identify you as a specific individual.
• Kite Size Calculator data (weight and board size). To provide you with personalised kite size recommendations, the App asks for your body weight and board size. This information is stored strictly locally on your device. We do not transmit, collect, or store this physical data on our servers, nor do we share it with any third parties. Setting up the calculator is optional and the App works fully without it.
• Display preferences (choice of knots or m/s, and flags recording that you have completed the introduction and the tutorial). These are stored locally on your device only.

2.2 Data collected automatically

When you use the App, some technical information is processed automatically:

• Basic device information (device model, operating system version, language settings).
• Anonymised identifiers needed to deliver push notifications (Firebase Cloud Messaging token).
• IP address and basic request metadata, on the server side (through Cloudflare), for security, performance and debugging.
• IP address disclosed to map and forecast providers. The App displays a satellite map and a wind forecast that are loaded directly from third-party servers. As with opening any web page, those providers necessarily receive your IP address and standard request metadata. See section 5 for details.

We do not use this data to build a marketing profile of you, and we do not track your behaviour across other apps or websites.

3. Permissions the App requests

The App requests a single Android permission: notifications (POST_NOTIFICATIONS), and only at the moment you switch wind alerts on. If you decline, the App remains fully usable — only push notifications will not be delivered.

The App does not request access to your location, camera, microphone, contacts, photos, or storage. The map is always centred on the Kiteseason school at Lo Stagnone and never on your position.

4. Push notifications

The App uses push notifications to inform you when your wind alert conditions are met. To send notifications, we store:

• A push notification token (provided by Firebase Cloud Messaging).
• Your alert configuration (the conditions for sending the notification).

These data are primarily used to deliver the wind alerts you configured. Additionally, if you opt in to receive push notifications, we may occasionally (e.g. 1–2 times per season) send you informational or promotional alerts regarding new Kiteseason features, projects, or news.

You can completely disable all push notifications at any time — either by switching wind alerts off in the App, or in your device’s system settings for the App.

5. Third-party services

• Firebase Cloud Messaging (Google) — delivery of push notifications.
• Cloudflare — hosting and protection of our backend (Cloudflare Workers, KV storage, R2 storage for the webcam snapshot).
• Esri (ArcGIS World Imagery) — satellite map tiles displayed as the background of the main screen. When the map is shown, tile requests are sent directly to Esri servers, which therefore receive your IP address. The map is rendered using the open-source MapLibre library, which contains no tracking or telemetry of its own.
• Windguru — the wind forecast is displayed by embedding the official Windguru forecast widget, which is loaded from windguru.cz. Windguru therefore receives your IP address and may set its own cookies within that embedded content. The App blocks navigation away from the widget, so tapping it will not take you to the Windguru website.
• Google Play — distribution of the App. Google acts as an independent controller; please refer to Google’s privacy policy for details.

We do not share your personal data with third parties for their own marketing purposes.

6. How long we keep your data

• Wind alert settings and your notification token are stored in our Cloudflare KV storage for 90 days from your last update. If you do not use the App and the record is not refreshed, it expires automatically. If you switch wind alerts off, the record is removed.
• Data stored on your device (weight, board size, units, and the flags recording the introduction and tutorial) remain there until you clear the App’s data or uninstall the App. Uninstalling the App removes them.
• Server logs are kept only for the short period necessary for security and troubleshooting.

7. Legal basis for processing (GDPR)

If you are in the EU/EEA, we process your personal data on the following legal bases:

• Performance of a contract (Art. 6(1)(b) GDPR): to provide you with the core functionality of the App (displaying wind data, sending the alerts you configure).
• Legitimate interests (Art. 6(1)(f) GDPR): for basic server logs, troubleshooting, and ensuring the security of our services.
• Your consent (Art. 6(1)(a) GDPR): for enabling push notifications (both wind alerts and occasional informational updates). You can withdraw your consent at any time by disabling notifications.

8. In-app promotions and marketing

The App may display banners or links promoting our own services (e.g. kitesurfing trips, courses, or our shop). Tapping such a banner opens the target page in your browser, outside the App. As mentioned in section 4, we may also occasionally send promotional push notifications related to our own services. These are simple promotions of our own offering and are not third-party advertising networks. We do not share your personal data with third parties for their marketing purposes.

9. Children

The App is not directed at children and we do not knowingly collect personal data from children.

10. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The date at the top of this document always indicates the current version.

11. Your rights (EU / GDPR)

You have the right to access, rectify, or erase your personal data, as well as the right to data portability and the right to object to processing. You also have the right to lodge a complaint with a supervisory authority (in the Czech Republic, the Office for Personal Data Protection).

Terms of Use

By downloading, installing or using Kiteseason (“the App”), you agree to be bound by these Terms of Use. The App is operated by Kiteseason s.r.o., a company registered in the Czech Republic (Company ID / IČO: 01397982), referred to in these Terms as “we” or “us”.

1. Use of the App

The App is provided for informational and recreational purposes, primarily to display wind data and send wind alerts. You agree to use the App only in accordance with applicable laws.

2. No guarantee of accuracy and safety

2.1. While we strive to provide useful information, we do not guarantee the accuracy, completeness, or timeliness of any data displayed in the App, including wind data retrieved from weather stations, which may occasionally be inaccurate, delayed, or offline. The same applies to the atmospheric pressure reading, which comes from a nearby airport weather report, to the satellite map, and to the wind forecast provided by Windguru.

2.2. Weather and wind conditions can change rapidly and unpredictably. Any kite size recommendations provided by the App (based on the weight and board size you input) are strictly rough, theoretical estimates. The App cannot assess your personal kiting level, current physical condition, or the specific local topography.

2.3. You must always adapt your equipment choice to your actual skills, current gusts, and real-time water conditions. You should always verify weather conditions using your own visual judgement and common sense before launching a kite.

2.4. Wind alerts are delivered over push notification services operated by third parties and depend on your device settings, network connectivity, and the availability of the weather station. We do not guarantee that any alert will be delivered, delivered on time, or delivered at all. Never rely on the absence of an alert as an indication of conditions.

2.5. The webcam and the school itself operate seasonally (approximately May to October). Weather station data is available year-round.

2.6. You use the App entirely at your own risk. To the maximum extent permitted by law, we are not responsible or liable for any personal injury, death, equipment damage, or any other loss that may occur as a result of using, or relying on any information or recommendations (including kite size calculations) provided by the App.

3. Intellectual property

The App, including its design, code, graphics, and logos, is protected by intellectual property laws. You are granted a personal, non-exclusive licence to use the App on your device.

Map data is provided by Esri and its data providers (Esri, Vantor, GeoEye, Earthstar Geographics, CNES/Airbus DS, USDA, USGS, AeroGRID, IGN, and the GIS User Community). Forecast data is provided by Windguru.

4. Limitation of liability

To the maximum extent permitted by law, we are not liable for any damages or personal injury arising out of or in connection with your use of the App.

5. Governing law

These Terms are governed by the laws of the Czech Republic.
